application of OSI ORGANIZACION SANITAS INTERNACIONAL to the following mark in class 36 (health insurance activities)<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-06e0cf7 elementor-widget elementor-widget-image\" data-id=\"06e0cf7\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"image.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<img decoding=\"async\" width=\"300\" height=\"176\" src=\"https:\/\/www.veralaw.com\/wp-content\/uploads\/2018\/05\/3-300x176.png\" class=\"attachment-medium size-medium wp-image-1064\" alt=\"\" srcset=\"https:\/\/www.veralaw.com\/wp-content\/uploads\/2018\/05\/3-300x176.png 300w, https:\/\/www.veralaw.com\/wp-content\/uploads\/2018\/05\/3.png 485w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/>\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ce1c32c elementor-widget elementor-widget-text-editor\" data-id=\"ce1c32c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Blue Cross contended that the blue cross of OSI\u2019s mark,\u00a0its\u00a0dominant feature, is confusingly similar to its logo.<\/p><p>The IPO Bureau of Legal Affairs dismissed the opposition of Blue Cross and pointed out the lack of similarity between the two marks. The Honorable Bureau explained that &#8211;<\/p><p><em>\u201cFirstly, the Respondent-Applicant\u2019s cross device is accompanied by the letters \u201cOSI\u201d and the word \u201cOSI ORGANIZACION SANITAS INTERNACIONAL\u201d, none of which is present in the Opposer\u2019s mark.<\/em><\/p><p><em>Secondly, the figures of the cross or plus design are distinctive from each other. The Opposer\u2019s \u201cCROSS DESIGN\u201d and \u201cCROSS AND MAN DESIGN\u201d marks both include a pie-shaped design cut into a figure of a man inside the cross or plus design. On the other hand, the Respondent-Applicant\u2019s cross or plus logo looks cut slanted in half, the cut portion of which is separated by an S-shaped or wave-like space.<\/em><\/p><p><em>Thirdly, the symbol of a cross or plus is commonly used in hospitals, medicine and other health-related services. In fact, the Trademark Registry of this Office reveals several other trademarks involving insurance, medical and hospital services appropriating a cross or plus design xxx\u201d<\/em><\/p><p>This decision is not yet final pending the resolution of the appeal lodged by Blue Cross to the Director of the Bureau of Legal Affairs.<\/p><p>Blue Cross and Blue Shield Association v.
