{"id":1320,"date":"2015-05-19T23:24:57","date_gmt":"2015-05-19T23:24:57","guid":{"rendered":"http:\/\/203.160.174.5\/?p=1320"},"modified":"2023-11-24T06:12:17","modified_gmt":"2023-11-24T06:12:17","slug":"apple-inc-versus-solid-broadband-corp","status":"publish","type":"post","link":"https:\/\/www.veralaw.com\/?p=1320","title":{"rendered":"Apple Inc. versus Solid Broadband Corp."},"content":{"rendered":"<p><span style=\"color: #000000;\">Manila, Philippines- Myphone, the first locally-branded mobile phones in the Philippines has won in a trademark dispute with multinational technology company Apple Inc.<\/span><\/p>\n<p><span style=\"color: #000000;\">In a decision rendered on May 19, 2015, the Intellectual Property Office (IPO) BLA ruled in favour of Solid Broadband Corp., the company behind Myphone.<\/span><\/p>\n<p><span style=\"color: #000000;\">The IPO BLA described Apple as \u201ca giant trying to claim more territory than what it is entitled to, to the great prejudice of a local \u2018Pinoy Phone\u2019 merchant who has managed to obtain a significant foothold in the mobile phone market through the marketing and sale of innovative products under a very distinctive trademark.\u201d<\/span><\/p>\n<p><span style=\"color: #000000;\">In 2009, Apple filed a case against Solid Broadband Corp., alleging that the Myphone mark is confusingly similar to their iPhone mark which can cause deception and confusion.<\/span><\/p>\n<p><span style=\"color: #000000;\">But the IPO found the competing marks, Myphone and iPhone to have no absolute confusing similarity ruling that \u201cWhile the marks are similar with respect to the word (\u2018phone\u2019), it is not sufficient to conclude that confusion among the consumers is likely to occur. \u2018Phone\u2019 is a generic term for mobile phones products.\u201d, and that given the fame and popularity of iPhone, it is highly doubtful for anyone to confuse it to a MyPhone product.<\/span><\/p>\n<!-- AddThis Advanced Settings generic via filter on the_content --><!-- AddThis Share Buttons generic via filter on the_content -->","protected":false},"excerpt":{"rendered":"<p>Manila, Philippines- Myphone, the first locally-branded mobile phones in the Philippines has won in a trademark dispute with multinational technology company Apple Inc.
