{"id":158,"date":"2018-02-03T05:28:19","date_gmt":"2018-02-03T05:28:19","guid":{"rendered":"http:\/\/localhost\/?p=158"},"modified":"2023-11-24T05:59:17","modified_gmt":"2023-11-24T05:59:17","slug":"frost-bites","status":"publish","type":"post","link":"https:\/\/www.veralaw.com\/?p=158","title":{"rendered":"FROST BITES"},"content":{"rendered":"<p><span style=\"color: #000000;\">Last 22 December 2017, the Bureau of Legal Affairs of the Intellectual Property Office of the Philippines dismissed Wendy\u2019s International LLC\u2019s opposition against Costa Limited\u2019s trademark application for \u201cFROSTINO\u201d for \u201cice based drinks containing coffee, vanilla, and\/or chocolate\u201d in Class 30 and other beverages in Class 32.<\/span><\/p>\n<p><span style=\"color: #000000;\">Wendy\u2019s International LLC anchored its opposition on its trademark registration for \u201cFROSTY\u201d which is registered for \u201cfrozen dairy desserts; as far as included in Class 30 and not in other classes\u201d.<\/span><\/p>\n<p><span style=\"color: #000000;\">The Bureau of Legal Affairs held that the manifest similarity between the two marks is the beginning letters \u201cF-R-O-S-T\u201d. However, it held that it is noteworthy that both marks pertain to goods which are cold and\/or iced food products. It found that a trademark which appropriates the prefix \u201cFROST\u201d and is used on this line of products is a weak mark.<\/span><\/p>\n<p><span style=\"color: #000000;\">The Bureau further discussed that the Trademark Registry shows many other proprietors that appropriate the word \u201cFROST\u201d pertaining to iced or cold food products such as \u201cFROSTEE\u201d, \u201cMR.
